Resurrection Health Care Uninsured Patient Class Action
CHICAGO -- Resurrection Health Care has agreed to a settlement in the case of Niewinski et al. v. Resurrection Health Care, a lawsuit filed in 2004 as a class action on behalf of uninsured patients.
The settlement is not a finding that Resurrection committed any improper or wrongful action. Plaintiffs in the lawsuit had claimed that Resurrection hospitals charged uninsured patients unreasonable rates for the medical services. Resurrection disputes the charges.
Resurrection agreed to enter into the settlement primarily to reaffirm its long-standing commitment to financial assistance and to put to rest all controversy.
General terms of the settlement are as follows:
- Since 2001, Resurrection Health Care’s financial assistance policy has undergone periodic revisions to offer larger discounts to uninsured patients.
- The settlement applies a new pricing policy in effect in 2009 to all patients and provides vouchers to any patients who would have been eligible for assistance but did not apply for it, or did not receive it for some other reason.
- Uninsured patients who received medically necessary services at a Resurrection hospital during the period from September 16, 2001 to September 19, 2008, will be eligible to have their outstanding bill recalculated.
- Refunds will be provided to anyone who made payments on a bill that would have been less had the current policy been in effect at the original time of service. Refunds will generally be in the form of vouchers for future medical services at a Resurrection hospital facility and will only apply to those who actually made payments on hospital bills of $500 or more.
- Based on claims submitted as of January 12, 2009, Resurrection does not expect a high level of refunds will be issued.
